New York May Soon Permit Convicted Felons to Work in Casinos December 20, 2022 New York is on the verge of opening up employment with casinos to those with felony convictions on their record. This legislation would remove restrictions that have prevented casino operators from hiring many offenders, potentially reducing hiring shortfalls. Under state law, casinos and other facilities within New York's commercial gaming industry cannot employ anyone with a felony conviction on their record. As a result, in recent months, many casinos and "racinos" have struggled to hire enough qualified workers. However, this new legislation could open up thousands of potential candidates. In June, the New York legislature passed this legislation, Senate Bill 1443B. It aims to permit those with felony convictions to gain employment in the commercial gaming industry. This bill achieved strong bipartisan support with the State Assembly, which voted 110 to 34, and the Senate, which voted 56 to 7. According to Assemblyman Gary Pretlow, who introduced the bill to the Assembly, "We're trying to open up employment opportunities at the casinos. People deserve a second chance. They shouldn't be denied employment because they got a drug felony conviction." Furthermore, this bill emphasizes the following: "No casino key employee license shall be denied solely on the basis of a conviction of any of the offenses enumerated in this article as disqualification criteria or the commission of any act or acts which would constitute any offense under section one thousand three hundred eighteen of this title, provided that the applicant has affirmatively demonstrated the applicant's rehabilitation, pursuant to article twenty-three-a of the correction law, and that the applicant has a demonstrated and continuing history of employment with a gaming facility prior to the submission of the application." This bill provides exceptions for those with a prior felony conviction involving theft, fraud, perjury, embezzlement, or public integrity. Therefore, these exceptions will remain prohibited from employment or licensing. In addition, the New York State Gaming Commission will maintain the discretion to deny granting a license to any individual after reviewing their criminal records. With the measure passed, it now sits at the governor's desk for a signature or veto. However, the governor's office has not indicated how it may proceed with the measure. Instead, it has stated that the governor is reviewing the measure. Ultimately, the bill's future remains uncertain.
