Rideshare Platform Faces New Batch of Lawsuits Related to Inadequate Background Screening and Safety Policies October 11, 2022 A major ridesharing platform faces another batch of lawsuits from drivers and passengers alike. The drivers and passengers claim that they were physically and sexually assaulted during rides, accusing the company of failing to take action to protect platform users. According to the claims in these cases, the company did not maintain reasonable protections for users due to inadequate background checks and screening policies. These claims include seventeen rideshare lawsuits filed in Arizona, California, Connecticut, Illinois, Kentucky, Michigan, Ohio, Oregon, Texas, Virginia, and Wisconsin. Despite broadly similar claims, these cases are separate lawsuits, not a class action. Each lawsuit requests a trial by jury and does not specify a financial award. Instead, they only seek compensatory damages. This request includes compensation for all expenses and wages owed, damages caused by a loss of future earnings, reasonable attorneys’ fees, costs incurred, and punitive damages. Thirteen of these lawsuits came from drivers and passengers claiming to have faced sexual assault due to the platform’s inadequate safety measures to prevent the assaults. Furthermore, they claim the company failed to respond appropriately in the aftermath. According to an attorney representing some plaintiffs, the company could perform much more comprehensive background checks on its drivers. In addition, the attorney suggested the company place dashboard-mounted cameras in vehicles to reduce the number of instances and severity of physical and sexual violence. In response to these allegations, the company emphasized its commitment to the safety of its drivers and passengers. In a virtual press conference that included some drivers and passengers who filed lawsuits against the platform, the company stated that it requires every driver to undergo a rigorous screening process. This screening process includes an initial background check and annual and continuous screening processes, such as criminal monitoring. If a driver fails to pass these screenings, the company claims they bar the driver from the platform. In addition, every driver allegedly undergoes a community safety education course designed in partnership with an anti-sexual violence organization.
