Property Management Agency Agrees to Almost $10 Million Settlement Over Inaccurate Tenant Background Checks A property management company has reached a staggering $9.73 million agreement. This agreement settles the claims that it violated the Fair Credit Reporting Act (FCRA) by inaccurately reporting tenant background checks. The class action lawsuit alleged that the company used criteria in sex offender registry data, which resulted in reports of inaccurate data for tenant screening. In this case, the defendant offers various services, including property management, financial management, marketing, sales, and tenant screening. In addition, individuals attempting to arrange a rental through the company may have a background check performed through the service. This case began in 2019 when the plaintiff launched the action against the rental company in the Eastern Virginia District Court. The claim alleged that the plaintiff attempted to rent a property in New Jersey. This attempt led to the rental agency requesting a background check from the defendant. Unfortunately, in error, this report allegedly stated the plaintiff was a registered sex offender in Indiana, which resulted in the rental agency denying him the accommodation. Upon reviewing the report, the plaintiff claims that it was quickly evident that the sex offender record did not belong to him. In addition, the document allegedly displayed a different middle name, physical description, and date of birth. As a result, the plaintiff filed this class action. He represents himself and individuals who suffered similar inaccuracies. Specifically, he represents individuals subjected to background checks between June 2017 and March 2021 for rental applications. The class action lawsuit further explained how the inaccuracies would not have occurred if the defendant had performed their due diligence. Instead, the defendant violated the FCRA by failing to maintain reasonable procedures to ensure maximum possible accuracy. The defendant argues that its policies meet the requirements of the FCRA. Also, the defendant claimed that having access to full dates of births would have prevented this mismatch of records. Allegedly, full birthdates are not available to the public in the sex offender registries of every state. Though the company has maintained that it has not committed any wrongdoing, it agreed to settle the dispute for $9.73 million. In addition, all class members will receive an equal payment from the settlement fund, estimated to be approximately $300.
