The OSHA Injury and Illness Posting Deadline Has Arrived Employers should be aware that workplaces covered by the Occupational Safety and Health Administrations' (OSHA) record-keeping rule must post a summary of work-related injuries and illnesses. To be posted in a conspicuous location from February 1st to April 30th, 2022. A significant number of employers, with 11 or more employees, except for certain exempt low-risk industries, are required to maintain a record of all work-related injuries and illnesses. This typically excludes minor injuries that do not require treatment beyond first aid. For each injury or illness that occurs, employers must complete an incident report, specifically Form 301, as well as log the work-related incident on OSHA Form 300. This information will be summarized in Form 300A and posted on the worksite. The information it gives will help employees, OSHA, and the employer themselves to gain a greater appreciation for relevant hazards and how workers may be protected from injuries in the future. Notably, every establishment must maintain a separate Form 300 log for recorded incidents. To determine an "establishment," the regulation defines it as "a single physical location where business is conducted or where services or industrial operations are performed." For employees, without a single physical worksite, an establishment will be the location where they are supervised or which acts as their base. It is important to remember that even in cases where an employer does not have any recordable injuries or illnesses, they are still likely required to submit a Form 300A. There are limited exceptions for companies based on size and for low risk-industries. The form should be placed in a conspicuous location where other required notices are posted, and for employees that do not report to a fixed location, a summary should be provided. For employers that may not have returned to a physical worksite at all, it is recommended that the form be posted on the company's intranet page or another location online where employees can easily access it. The physical notice must be posted if employees return to the worksite before April 30th. Before posting the OSHA Form 300A, it must be reviewed by a qualifying executive of the company who will certify that they have "examined the OSHA 300 Log and that he or she reasonably believes, based on his or her knowledge of the process by which the information was recorded, that the annual summary is correct and complete." The qualified company executives include: An owner of the company. An officer of the corporation. The highest-ranking company official working at the site. The immediate supervisor of the highest-ranking company official working at the site. Finally, some employers will be required to file their Form 300A with OSHA electronically. This includes employers of 250 or more who are not exempt from keeping injury and illness records and those with 20 to 249 employees within specific industries.
