CFPB Publishes Final Rule Amending Model Adverse Action Form March 29, 2023 The Consumer Financial Protection Bureau (CFPB or Bureau) recently issued a final rule. Among other updates, this rule provides a new model form for the Fair Credit Reporting Act (FCRA) Summary of Consumer Rights. It also mentioned a requirement for including information in any adverse action notices by the Equal Credit Opportunity Act (ECOA). In the Summary of Consumer Rights model form, the CFPB will correct the section containing multiple federal agencies' contact information. It also includes the Federal Deposit Insurance Corporation and the Comptroller of the Currency (OCC). The CFPB will also update references to obsolete business types, making additional technical corrections where required. Furthermore, the Bureau will amend Appendix A. This appendix includes federal agency contact information that creditors must have in ECOA adverse action notices. Additionally, the agency will correct Appendix D to list the correct contact information for the agency. The Summary of Consumer Rights details certain consumer rights provided by the FCRA. Consumer reporting agencies (CRAs) must supply the Summary of Consumer Rights to consumers with any written disclosures. They must also offer it before providing consumer reports for employment purposes. Additionally, a user must provide a Summary of Consumer Rights with the required disclosure before acquiring an investigative consumer report. This step also applies before taking any pre-adverse action notices for employment purposes. Individuals can obtain this form on the CFPB's website. The ECOA supplies model language that satisfies specific disclosure requirements of 12 CFR 1002.9(a)(2) related to adverse action notices. These notices must contain federal agency contact information from Appendix A to Regulation B. Therefore, the Bureau will revise the appendix to update these agencies' contact information. The agency will also update the contact information for the OCC, FDIC, and the Federal Trade Commission. In addition to this, appendix D to § 1002 explains the process that entities must follow when requesting official Bureau interpretations of Regulation B. As a result, the Bureau will amend paragraph 2, which users can find in Appendix D. This amendment would correct the zip code for the CFPB as well as replace the reference to the Division of Research, Markets, and Regulations. In addition, the reference will refer to the new Division of Research, Monitoring, and Regulations. The final rule will take effect on April 19, 2023. However, employers do not have to comply with the FCRA Summary of Consumer Rights amendments until March 20, 2024. This timeline will give creditors, CRAs, and employers who use the model forms and language time to change their documents and language.
