Connecticut Completes Expungement for More Than 40,000 Marijuana Convictions January 9, 2023 Connecticut state officials have finished reviewing and vacating over 40,000 criminal records belonging to residents with marijuana-related convictions. The Governor of Connecticut stated on social media that his administration had erased 42,964 cannabis convictions. In 2020, Connecticut passed a law regulating the adult-use cannabis market. This law also had provisions for automatically reviewing and expunging prior low-level cannabis convictions. However, individuals with serious marijuana-related records must petition the courts for relief. Finally, anyone with erased records may deny the convictions from landlords, employers, or schools. How the convictions get erased will depend on when the conviction occurred. Here are the specific conditions: “Convictions for violations of C.G.S. § 21a-279(c) for possession of under four ounces of a non-narcotic, non-hallucinogenic substance imposed between January 1, 2000, and September 30, 2015, will be automatically erased on January 1, 2023. People included under this provision of the law need not do anything to make these convictions eligible for erasure. Convictions for the following violations can be erased if one files a petition in Superior Court: Convictions for violations of C.G.S. § 21a-279 for possession of less than or equal to four ounces of a cannabis-type substance were imposed before January 1, 2000, and between October 1, 2015, and June 30, 2021. Convictions for violations of C.G.S. § 21a-267(a) for possession with intent to use drug paraphernalia for cannabis were imposed before July 1, 2021. Convictions for violations of C.G.S. § 21a-277(b) imposed before July 1, 2021, for manufacturing, selling, possessing with intent to sell, or giving or administering to another person a cannabis-type substance and the amount involved was under four ounces or six plants grown inside a person’s home for personal use.” Twenty-four states have instituted laws allowing individuals with low-level marijuana convictions a chance to have their records sealed or expunged. However, many still find themselves affected by a past conviction for a low-level cannabis offense. This effect seems to persist despite most Americans no longer considering the behavior criminal. Marijuana will soon be available for adults in Connecticut at licensed retailers. At the same time, New York has begun allowing limit-use adult sales. Vermont and New Jersey have also started allowing licensed retailers to sell marijuana. With many people having had marijuana-related convictions expunged from their records, employers must ensure their hiring practices comply with all applicable laws.
