Insurer Claims FCRA Class Action Is Not Covered By Policy An insurance provider has asked a U.S District Court in the Eastern District of Missouri to clarify that it should not have to cover the cost of a consumer reporting company’s (CRA) $54 million settlement in a class action lawsuit regarding alleged violations of the FCRA. The insurance provider claims that the company acted in collusion with the class plaintiff in reaching the settlement. The insurance provider’s argument that it should not be required to provide coverage stems from claims the class plaintiff filed in response to an attempt to apply for a position with a North Carolina-based manufacturer of building materials. The class plaintiff had received a conditional offer of employment contingent on the outcome of a background check. Soon afterward, the prospective employer informed him that he was no longer being considered for the position but failed to provide him with a copy of the background check. As a result, this individual filed a class action lawsuit against the company alleging violations of the FCRA which resulted in a $2 million settlement the following year. This was then followed by a class action filed against the CRA, which provided the background checks for the employer. The CRA was defended by its insurance provider under a reservation of rights. The insurer states that the class plaintiff had filed a policy limits demand and proposed an amended complaint, which included three new classes in addition to another class plaintiff; however, this was never filed. Additionally, the insurer states that the CRA had been in contact with the class plaintiff without its consent, during which he indicated that he was open to arbitration. The class plaintiff dismissed the case, and on the same day, the insurer claimed that the counsel provided the CRA was dismissed and replaced with a new attorney. Both parties also engaged in an arbitration settlement, which the insurer alleges was collusive in addition to being 27 times greater than the settlement with the employer. A Missouri state court confirmed this settlement on April 14, 2022. Additionally, the insurer noted that the CRA had performed less than 4,000 background checks for the employer, of which only 336 had been denied employment. However, the arbitration had noted that 27,000 FCRA violations had occurred. The insurer claims that the CRA’s failure to notify, cooperate, or receive the insurer’s consent prior to entering into an agreement with the class plaintiff violated the terms of its policy. As a result, the insurer claims that it was denied the ability to manage the defense and defend its own interests, which could have greatly mitigated the damages.
