EEOC Adds Non-Binary Gender Option for Charges of Discrimination The U.S. Equal Employment Opportunity Commission (EEOC) has announced that it will be adding another option to the self-identification intake process for individuals filing a charge of discrimination. The Agency's current form offers only two gender options, male and female; however, soon, the EEOC will add the nonbinary option "X" for those who do not wish to identify as either of the two former categories. This announcement came on Transgender Day of Visibility, which celebrates the achievements of the transgender community. It also continues the White House's current initiative to increase gender inclusion by the federal government. To this end, the White House has released a fact sheet showing changes being made by agencies across the federal government to support inclusion for transgender Americans. This includes creating an "X" gender marker option for certain agencies and forms. Among these is the EEOC furthering its mission to protect workers and stop workplace discrimination by recognizing workers who do not identify as male or female. Learn More In the Agency's announcement, EEOC Chair Charlotte A. Burrows stated, "The addition of a nonbinary gender marker to the EEOC's charge intake process will be an important step to promote greater inclusion for members of the LGBTQI+ community." In order to recognize those who do not identify as a non-binary gender, the EEOC is updating the process to include an "X" option in two stages of the process for intake and filing a charge of discrimination. This includes the voluntary questions relating to demographics on the online portal for submitting inquiries concerning the process of filing a charge of discrimination, the online Spanish Initial Consultation Form, and the Precharge Inquiry Form. In addition, the list of prefix options for the charge of discrimination form will now include "Mx." This incorporates a proposal made by the CDC's National Center for Health Statistics for defining "X" in such a way as it will promote inclusion, clarity, and privacy for everyone. Based on this definition which was come to through user testing, "X" can be defined in one of two ways, including" unspecified for those who would prefer not to answer or "another gender identity" for those who do not wish to identify as one of the other two gender options. Notably, this may not be the only change the EEOC will soon be making, as the Agency recently suggested that it would be adding a non-binary option for the EEO-1 form. This form which must be submitted by employers of 100 or more, includes details on protected categories of workers. However, such a change will require a vote by the full commission and the Office of Budget and Management approval.
