Lawyer Who Claims Inaccurate Consumer Report Cost Judgeship Reaches Settlement October 31, 2022 At the beginning of the year, a South Carolina lawyer accused a consumer reporting agency (CRA) of costing her a chance at a position as a judge. Now, a federal court has settled with the CRA and lawyer. According to the filings, the settlement resolved the allegations that the agency violated the Fair Credit Reporting Act (FCRA). The plaintiff, a solo family law practitioner, filed this complaint in February. According to the complaint, she attempted to move to another county for a judgeship and acquire a mortgage. However, after receiving a denial for the mortgage, she realized the report provided inaccurate information because it belonged to someone else. As a result, she filed multiple disputes with the CRA to correct the errors. Over the next seven months, the plaintiff filed three separate disputes with the CRA, each with required supporting materials. However, these went uninvestigated. According to the CRA, it could not confirm her identity and thus took no steps to investigate. As a result, the plaintiff alleges she lost the judgeship opportunity despite earning initial approval from the screening committee. The plaintiff filed a complaint alleging violations of the FCRA's consumer protections with the U.S. District Court for the District of South Carolina. These complaints regarding inaccurate credit reports have become increasingly common since the onset of the COVID-19 pandemic. Today, the single largest complaint category is the inclusion of data belonging to other individuals. A January 2022 report from the Consumer Financial Protection Bureau (CFPB) found that the three major credit reporting agencies only provided consumers relief in 2% of filed disputes in 2021. This statistic sharply contrasts with 2019's 25% consumer relief. As a result, the CFPB accused these CRAs of ignoring their responsibilities to investigate consumer disputes under the FCRA. In this case, the CFPB reported that the CRA frequently refused to investigate complaints due to believing third parties filed the complaints. These cases have led to CRAs paying out tens of millions over the previous decade to settle class actions. In this case, the plaintiff and defendant informed the court that they had resolved the dispute. However, they have provided no details on the settlement terms.
