Congress Reduces Employment Restrictions at Financial Institutions for Those With Criminal Records February 7, 2023 The President has approved a defense spending bill that impacts financial institutions by reducing restrictions on hiring individuals with criminal records. The 2023 National Defense Authorization Act includes provisions that lower the number of convictions that prohibit a person from securing specific employment. Under Section 19 of the Federal Deposit Insurance Act (FDIA), individuals with criminal records can now secure employment at financial institutions without needing a written waiver from the Federal Deposit Insurance Corporation (FDIC). These changes, outlined in Section 5705, "Fair Hiring in Banking," have already been implemented. Previously, Section 19 of the Federal Deposit Insurance Act imposed a ban on employment at financial institutions for anyone convicted of crimes related to money laundering, dishonesty, or breach of trust, or for those who participated in a pretrial diversion program. Banks were also required to conduct background checks on job applicants, superseding state and local laws. In July 2020, the FDIC revised Section 19 by reducing the number of offenses that would prevent someone from working in the financial sector. This included expanding the definition of expungement to cover sealed criminal records and references to pretrial diversion programs."The new provisions further loosened the probations on hiring. For example, it no longer requires a waiver if seven or more years have passed since the offense. Individuals released from incarceration at least five years ago also do not need the waiver. Finally, crimes committed before turning 21 will not require a waiver, assuming 30 or more months have passed. The Fair Hiring in Banking provisions also allows the FDIC to exempt additional de minimus offenses. They can do so through determinations by rule. However, the conditions require a punishable term of no longer than three years. When the FDIC reviews an application to determine whether an applicant with relevant criminal convictions can work for a bank, they must make individualized assessments. These assessments must consider the following: Evidence of rehabilitation Age of the applicant when convicted or entered into a program The amount of time that passed since the conviction or entering into a program The relevance of the applicant's offense to the job responsibilities they will have Letters of recommendation The person's employment history Any completed job preparation or substance abuse programs The revised provisions offer increased job prospects for individuals with criminal records and expand the pool of applicants for financial institutions.
