Michigan Soon to Expunge Criminal Records Under Clean Slate Act February 01, 2023 State officials in Michigan plan to automatically expunge some criminal records. This plan would help increase opportunities for jobs and housing for people with criminal records. Should it pass, Michigan residents who meet specific criteria would see their criminal records automatically expunged. Michigan's State Police runs the expungement process system, which has proven labor intensive. As such, offenders who wish to have their records expunged must apply for the State Police's review. The Department of Attorney General will then complete a history report and file a response to the application, potentially leading to an expungement hearing. Unfortunately, the entire process could take as long as eight months. In addition, due to the difficulty of the process, many eligible individuals choose not to apply. Automatic expungements for some convictions will begin in April, as Michigian's 2021 Clean Slate Law requires. As a result, these convictions will not require an application. In addition, the process will have the Michigan State Police utilize an algorithm coded to the statutory eligibility criteria. These criteria will generate a list of the convictions eligible for expungement each month. The courts will update their files using case management systems through this list. However, not all convictions can receive an expungement, such as cases involving serious injury or death. Other ineligible records include serious misdemeanors and assaults. Once the courts accept the data from Michigan's State Police, they can move appropriate documents into the systems. This process ensures that the public can no longer access the expunged information. According to a 2020 study by the University of Michigan Law School, when people have their criminal records expunged, they usually see an improvement in their employment and wages. Wages typically increase by 22% within a year. Additionally, the study found that 96% of the individuals who had their records expunged did not experience additional convictions. Unfortunately, the study found that only 6.5% of eligible applicants apply for expungement within five years of eligibility. This result has proven the case despite the many advantages of expunging records. As such, the Michigan Clean Slate Law will make it easier for people to take advantage of having expunged criminal records. This law will benefit employers as well with the current labor shortages. However, employers must update their hiring practices to comply with this law.
