Connecticut’s Clean Slate Has Taken Effect for the New Year January 19, 2023 Recently, 44,000 cases that involved convictions for cannabis possession received either full or partial expungement. In addition, those with eligible convictions, including most misdemeanors and some lesser felonies, can expect erased convictions in the latter half of 2023. Unfortunately, the expungement has implemented delays. Due to these delays, the governor has encouraged necessary technology upgrades. These upgrades would allow criminal justice agencies to determine which individuals will have their convictions sealed. The Clean Slate Act went into effect in 2021 to help individuals with convictions for low-level crimes on their records to overcome employment barriers. However, the act only helps those without additional involvement with the criminal justice system. In addition, the bill puts a process to erase most misdemeanor and some felony convictions after a certain time. The law has already erased thousands of convictions for cannabis possession. These swift erasures have saved significant time and money by eliminating the requirement to request expungement through Connecticut’s Board of Pardons and Parole for low-level offenses. The law also simplifies the procedure for expunging other crimes by applying to the Superior Court for convictions before January 1, 2000. Additionally, the law protects individuals who have had their records erased. For example, Connecticut already restricted employers from using an applicant’s or employee’s criminal history or erased criminal history as the basis for some employment decisions. However, the Clean Slate Act bans employers from denying applicants employment or discriminating against current employees based on erased criminal history records. The Clean Slate Act also allows applicants or employees with erased records to deny any arrest or conviction regarding the erased offenses. However, in cases where employers can ask about criminal history, employers must provide notice in clear, conspicuous language that applicants do not have to disclose erased arrests or convictions. Some states, such as Connecticut, limit what questions employers may ask. Additionally, employers cannot advertise employment opportunities in a way that restricts the employment of persons with erased criminal records. The Clean Slate Act also classifies violations as discriminatory acts. As a result, employees who feel their employer or potential employer has violated the act may file an employment discrimination complaint.
