New Paid Sick Leave Requirements for Colorado Employers in 2022 As of the start of this year, all employers in Colorado, no matter their size, are facing paid sick leave requirements due to the Healthy Families and Workplaces Act. This means all employers, including small businesses, should be aware of their sick leave obligations. Obligations Under the Healthy Families and Workplaces Act Starting from January 1st, 2022, employers are required to provide one hour of paid sick leave for every 30 hours an employee works. This will accrue up to a maximum of 48 hours. This is the same requirement which employers of 16 or more employees have faced since January 1st, 2021. Employees will begin accruing this leave as soon as they are employed, and it may be used as it is accrued. Any unused leave will carry forward into future years after accrual. For employers that already have a more generous paid sick leave policy, the additional leave will not be necessary, but it must accrue as rapidly, be available immediately, and be granted to part-time employees as well. These employers will also need to provide notice that additional leave will not be granted due to already meeting the HFWA's requirements. The act describes this paid sick leave as "wages"; however, the act does state that upon termination, an employer is not required to pay out any unused paid sick leave. If an employee is rehired within six months of this termination though, any unused paid sick days must be reinstituted. In the case of any successor employers, this leave will be carried over as well. What Can This Leave Be Used For? An employee may use any accrued sick leave for the following purposes: The diagnosis, treatment, or care of any physical or mental illness, injury, medical condition, or preventative medical care. The care of a family member who requires the diagnosis, treatment, or care of any physical or mental illness, injury, medical condition, or preventative medical care. The employee or any of their family members has been the victim of domestic abuse, sexual assault, or harassment, and any form of absence is required for a reason related to these crimes. A public health emergency has resulted in a public official ordering the closure of a place of care, including schools for the employee's child resulting in the employee needing to be absent. In the case that an employee is absent for four or more consecutive days, an employer may demand documentation. Employer Takeaways For employers that haven't already done so, they should review their policies and update their paid-leave and Colorado Overtime and Minimum Pay Standards (COMPS) posters. They should also ensure that COMPS Order #38 is provided in all handbook updates to employees. These updates will ensure that employees are aware of their rights under the HFWA, but it is also essential to ensure that HR and managers are made aware of these new requirements.
