Nebraska Judiciary Committee Considers Bill to Provide a Clean Slate for Tenants March 23, 2023 The Judiciary Committee in Nebraska will consider LB-175, the Residential Tenant Clean Slate Act. This bill would permit tenants to obtain clean slate relief, automatically sealing the court record in specific cases. An example includes when a trial court issues an order dismissing an eviction proceeding against a tenant. It would also provide a cause of action. This cause of action allows tenants to seek relief after a minimum of three years since an eviction judgment. However, the tenant must pay any restitution to qualify in that example. Otherwise, the following examples qualify if an eviction action: Was not carried out Ended in dismissal, but the record stayed public Resulted in a judgment that ended up reversed or vacated The law currently has an eviction case stay on a person's record even when dismissed. As is, the law makes it difficult for people to find housing. One lawmaker commented that dismissed cases should not remain on a person's record, regardless of the reason. Sealing eviction records would protect tenants from wrongly struggling with limited housing options. An example mentioned concerns limits caused by judicial action that did not end in eviction. Another included judicial action that did not accurately indicate their current conduct. Under the current law, filed evictions stay on a person's permanent record. As a result, these evictions count against them when looking for housing. Unfortunately, this includes eviction notices filed incorrectly or dismissed without making it to court. In cases that make it to court, tenants must often agree to any stipulations made. After an agreement, the attorney for the property owner typically dismisses or vacates the eviction. Evictions can have devastating consequences on a tenant's life, and they will go to extremes to avoid them. Many go as far as choosing not to exercise their rights or living in poor conditions. Sometimes, tenants even comply with illegal terminations to prevent an eviction filing. Passing LB-175 would significantly benefit tenants, though people have voiced concerns about the bill's effect on property owners. For example, the bill has faced complaints about interfering with a property owner's ability to choose the best tenants. It would do this by limiting the ability of property owners to find out about the past behavior of tenants. It remains uncertain if this bill will pass because the committee has not taken any action so far.
