The Details on Michigan’s Legislation Requiring Background Checks for Senior Care Employees October 18, 2022 Michigan's Governor Gretchen Whitmer signed House Bill 4325 into law earlier this year. House Bill 4325 requires and standardizes background checks for most employees and volunteers working with seniors. These changes amended existing state law and expanded the scope of personnel who must receive background screening significantly. Furthermore, House Bill 4325 amended the Older Michigans Act. This act regulates key areas of industry and activities relating to seniors in Michigan. In this case, House Bill 4325 requires that "area agencies on aging" conduct criminal background checks on most personnel. The mentioned personnel include employees, contractors, subcontractors, and volunteers who have: In-person client contact; In-home client contact; Access to a client's personal property; or Access to confidential client information. Employers covered by the legislation must perform a criminal history check, such as the ICHAT search through the Michigan State Police. In addition, they must conduct searches of the state and national sex offender registries. These employers must also update the criminal background check for each employee or volunteer every three years after their start date or date of hire. The information gained from a criminal background check is only for determining suitability for employment or volunteer opportunities. Furthermore, the agency must maintain the background check results in a secure location. This documentation includes a list of all volunteers and staff covered by the section, the provider of the background check, and the most recent date that staff underwent a background check. Employees and volunteers who faced conviction, entered a plea of guilty or nolo contendere, or proved guilty of certain offenses cannot interact with the elderly, access their property, or access their information under House Bill 4325. These include a wide range of federal or state offenses, such as violent crimes such as murder, or assault, sex crimes, abuse or neglect, or a crime against a vulnerable adult. Certain federal or state felony offenses count if they occurred within the preceding ten years. In addition, certain misdemeanor offenses count if they precede within five.
